Tokopi early-access terms

These terms cover the Tokopi waitlist and early-access programme operated by Optiop GmbH. Optiop GmbH's general terms and conditions are available athttps://optiop.de/terms-and-conditions/ and apply in addition to these.

The waitlist

Submitting the waitlist form is an application, not a purchase and not a guarantee of access. We may accept or decline any application, and we may close the programme at any time. Nothing on this site is an offer capable of acceptance.

Pre-release software

If we invite you into early access, the software you receive is pre-release. It may be incomplete, may change substantially, and may be withdrawn. It is provided "as is", without warranty of any kind to the extent permitted by law, and should not be relied on for business-critical work.

We may discontinue Tokopi, or any part of it, without becoming liable to you for doing so.

Feedback

If you send us feedback, suggestions, or bug reports, we may use them to improve Tokopi without restriction and without owing you compensation. Please do not send us anything you consider confidential.

Your responsibilities

• Provide accurate details, and keep them current.
• Ensure you are authorised to connect Tokopi to your organisation's tools and cloud accounts, or involve someone who is.
• Do not attempt to reverse engineer, resell, or sublicense the preview build.

Liability

Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for intent, or for gross negligence. Subject to that, Optiop GmbH is not liable for indirect or consequential loss, loss of profit, or loss of data arising from the waitlist or from pre-release software.

Relationship to Atlassian

Tokopi is developed by Optiop GmbH and is not affiliated with, endorsed by, or sponsored by Atlassian or by any cloud provider. Jira and Confluence are trademarks of Atlassian Pty Ltd. Your use of those products, and of your cloud accounts, remains governed by your agreements with their providers.

Governing law

These terms are governed by German law. The courts of the Federal Republic of Germany have jurisdiction, insofar as a place of jurisdiction may lawfully be agreed.
